Commonwealth Department of Environment and Energy

An Environmental Protection and Biodiversity Conservation (EPBC) Referral was lodged with the Department in December 2016, and a decision notice was received in March 2017 that the proposal was considered a “controlled action” under the EPBC Act.

Victorian Department of Environment, Land, Water and Planning

A referral was made under the Environment Effects Act 1978 to the State Minister for Planning in November 2017.  The Minister confirmed on 27 December 2017 that an Environment Effects Statement (EES) was not required for the project.

Bilateral assessment by State and Commonwealth

As the Commonwealth deemed the project to be a “controlled action”, a bilateral assessment process has been undertaken by the State and Commonwealth departments.

This documentation sits alongside the planning permit application.

Planning application

A Planning Permit Application was submitted with the Department of Environment, Water, Land and Planning in September 2017.  Once the Bilateral Assessment has been completed the planning application will be advertised for public exhibition.  The exhibition period will be for a period of 28 days.
