Please note: In the case of direct or indirect references to external web pages ("links") which lie outside the responsibility of the author, a liability obligation would only come into force if the author had knowledge of the content and if it was technically possible and reasonable to prevent the usage of illegal content. The author declares explicitly that at the time of setting the links, the relevant linked pages were free from illegal content. The author has no influence on the current and future creation of the linked to/referenced pages. He therefore hereby distances himself expressly from any content in all linked to/referenced pages which was modified after the links were set. This statement applies to all links and references set within his own website and to external entries in guest books, discussion forums and mailing lists set up by the author. Regarding illegal, inaccurate and incomplete content and in particular for any damages ensuing following the usage or non-usage of such displayed information, the sole liability rests with the provider of the referenced page not to the person who links to that published page. In the judgement dated 12 May 1998 -312 O 85/98- "Liability for Links" the district court in Hamburg decided that by adding a link, the author has to be co-responsible for the content of the linked page. This can only be prevented - according to the district court - by an explicit statement distancing oneself from the external content. |
